About These Terms

These terms govern the web design services provided by Eyebright Websites, operated by Will Hart, based in Dartington, Devon.

Our Services

We provide:

• New websites: Squarespace websites, custom websites with CMS, and fully managed custom websites
• Website improvements: Redesigns, logo design, carbon footprint audits, and content updates
• SEO packages: Strategy and optimisation to help customers find you online
• Online advertising: Setup and management of Google and social media ad campaigns
• Custom digital tools: Bespoke calculators, quote tools, and automations
• Ongoing support: Maintenance, hosting, and ad-hoc updates

Project Process

Getting Started

• All projects begin with a consultation to understand your requirements
• A detailed quote will be provided before work begins
• 50% payment is required upfront to commence work
• Remaining 50% is due upon project completion

Timeline and Delivery

• We provide estimated delivery timeframes for each project
• Typical projects complete within 2-8 weeks depending on scope
• Final payment is due within 90 days of project start date, even if completion is delayed due to client-side requirements or feedback delays
• We commit to completing work professionally and promptly on our end

Your Responsibilities

• Provide content, images, and feedback in a timely manner
• Respond to requests for clarification within reasonable timeframes
• Ensure any content provided does not infringe third-party rights
• Provide access credentials when required (e.g., domain management, hosting accounts)

Payment Terms

• Deposit: 50% required before work begins
• Final payment: Due upon completion or within 90 days of start date
• Late payments: May result in project suspension or additional charges
• Currency: All prices quoted in GBP (£)

Refunds

• If you're unsatisfied with our work, we're committed to discussing solutions
• For projects cancelled early, minimum charge is the 50% deposit if work has commenced
• Each situation is considered individually and fairly
• No refunds for completed work that meets agreed specifications

Intellectual Property

• Upon full payment, you own the content and final website
• We retain the right to showcase your website in our portfolio
• Any custom code or templates remain our intellectual property but you have an unlimited license to use them
• You're responsible for ensuring all content provided doesn't violate copyright

Hosting and Maintenance

• Squarespace sites: Ownership transfers to you upon completion — you'll need your own Squarespace subscription (from £10/month)
• Custom sites: Includes 2 years free hosting, then £10/month self-managed or £60/month fully managed (includes updates and maintenance)
• Hosting liability: We make reasonable efforts to maintain uptime but cannot guarantee 100% availability
• General support: Available at £35/hour for ad-hoc requests, updates, or troubleshooting

Limitations of Liability

• Our liability is limited to the total amount paid for the specific project
• We're not responsible for loss of business, profits, or indirect damages
• We're not liable for issues arising from third-party services (hosting providers, domain registrars, etc.)
• For hosted websites: while we work promptly to resolve technical issues, we accept no liability for downtime

Termination

Either party may terminate the agreement with reasonable notice. Upon termination:

• Payment is due for all work completed to date
• We'll provide all completed work and assets
• Ongoing hosting arrangements continue unless separately cancelled

Governing Law

These terms are governed by the laws of England and Wales.

Changes to Terms

We may update these terms occasionally. Existing clients will be notified of significant changes.
